These Terms of Service ("Terms") govern your access to and use of the BigLead website at biglead.io and the BigLead software platform at app.biglead.io (together, the "Services"), operated by BigLead ("BigLead," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.

Accounts

To use the platform you must create an account and provide accurate, complete information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

Acceptable Use

You agree not to misuse the Services, including by attempting to gain unauthorized access to any systems or data; interfering with or disrupting the Services; using the Services to send spam or unlawful communications; uploading malicious code; or using the Services in violation of any applicable law or regulation.

Your Content

You retain ownership of the data and content you submit to the Services ("Customer Content"). You grant us a limited license to host, process, and display Customer Content solely as necessary to provide the Services. You are responsible for the accuracy and legality of your Customer Content and for having the rights necessary to submit it.

Subscriptions and Payment

Certain features of the Services are provided on a paid subscription basis. Fees, billing periods, and payment terms are described at the time of purchase. Except where required by law, fees are non-refundable. We may change pricing with reasonable advance notice, effective at the start of your next billing period.

Intellectual Property

The Services, including all software, design, and content provided by us (excluding Customer Content), are owned by BigLead or its licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms or if necessary to protect the Services or other users. Upon termination, your right to use the Services ceases, and we may delete Customer Content in accordance with our data retention practices and applicable law.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, BigLead will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability for any claim arising out of these Terms or the Services will not exceed the amounts you paid to us for the Services in the twelve months preceding the claim.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
